This data protection policy governs access to and use of the Website service (hereinafter, the Website) that TEM makes available to users interested in its products and services.

This is our Privacy Policy. Before getting into details, we highlight a few key principles on which it is based.

The Privacy Policy has three objectives:

All the information we collect is related to the provision of Mundo Cuervo’s services and its features.   • We obtain your broad, non-specific location from your IP address. Our services and pricing vary depending on location, so we need to know which country you are located in. This also allows us to suggest recommendations based on your general location, such as transportation or interim stays.
  • The sections of our site you visit. This allows us to make recommendations and suggest relevant content.
  • Technical information. This includes the type of browser and device you use, helping us determine the format of our promotional campaigns and target audience.

The second category includes information that allows us to offer additional features. We will never receive any of the following data unless you explicitly choose to share it with us. It’s that simple. Here are some examples:

  • Your specific location: We will never collect or use your device’s specific location without first obtaining your explicit permission. This information allows us to suggest visits to various spaces during your stay and notify you of real-time activities (this applies only to the Mundo Cuervo and Club Mundo Cuervo mobile apps).
  • Your photos: We will never access your photo gallery.
  • Your contacts: We will never analyze or import your contacts.
  • Your microphone: We will never access or use your microphone.

The distinction between these two categories is important. The first category is information you need to provide to enable future contact with you regarding any questions about our services. When you accept our Privacy Policy, you give us the right to collect this information and use it for the purposes described. The second category of information will only be collected if you explicitly grant us permission to do so in the future. For this second category of information, we will request your permission before accessing it for the first time, describe how we will use it if you grant permission, and use the information only for the described purpose. You will always have the option to change your mind and revoke that permission. Accepting our Privacy Policy does not mean that you have given us permission to access or use the second category of information; we are simply explaining that we may ask for your permission to do so in the future.

In certain contexts, we will share specific information. For example, like most services, if you subscribe to Mundo Cuervo through a third party, such as Facebook or a mobile provider, we share some information with them, and they share some information with us to enable your account.     We may collect and store the following information:

3.1. Registration Data
When you sign up for the Service, we may request information such as your username, password, email address, date of birth, gender, address, postal code, and country. If you use the Service with third-party application authorizations (as defined in the Terms and Conditions of Use) (e.g., Facebook), you authorize us to collect your authentication information, such as your username and encrypted access authorizations. We may also collect other types of information that are available in your third-party application account, or through it, such as your name, profile picture, country, city of residence, email address, date of birth, and the names and profile pictures of friends and networks.

You may also voluntarily choose to add additional information to your profile, such as your mobile phone number and mobile service provider.

3.2. Usage, Log Data, and Cookies
When using or interacting with the Service, we may use various technologies to collect information about your use of and access to the service. We may collect the following information:

  • Information about your subscription type and your interactions with the Service, third-party applications, as well as advertisements, products, and services offered or available through the Service, or linked to it.
  • Details of any queries you have made and the date and time of your request.
  • User content (as defined in the Terms and Conditions of Use) that you post on the Service, including messages you send and receive through the Service.
  • Technical data, which may include URL information, cookie data, your IP address, the type of device you use to access or connect to the Mundo Cuervo service, the unique device identifier, device characteristics, network connection type (e.g., WiFi, 3G, LTE) and provider, network and device performance, browser type, language, digital rights management information, operating system, and Mundo Cuervo application version.
  • Data from mobile device sensors generated by motion or orientation (e.g., accelerometer or gyroscope).

You may integrate your Mundo Cuervo account with third-party applications. If you do so, we may receive similar information related to your interactions with the Service on the third-party application and information about your public activity on the third-party application. This includes, for example, «Likes» and posts on Facebook. We may use cookies and other technologies to collect this type of information. 3.3. Your Mobile Device
We may provide features that depend on the use of additional information from your mobile device or require access to certain services on your mobile device, which will enhance your experience on Mundo Cuervo, but are not required to use the Service. (In other words, this is information from the second category described in the Introduction to this Policy.) Granting us access does not mean you are giving us unlimited access to that information, nor will we access specific information without your permission. Instead, for each type of information mentioned in this section, before accessing this information or these features on your mobile device, we will request your permission. If you grant us such permission, we will collect the information for the specific purposes explained at the time we request your permission. You are not required to grant us such permission to use Mundo Cuervo, and accepting this Privacy Policy does not imply that you are granting us permission to access this information.

Specifically:

  • Photos and Camera: We will not access your photos or camera, and we will never analyze or import your photo library or recordings. We will only use the images you specifically choose to share with us from a third-party provider such as Facebook, Twitter, or Instagram.
  • Location: We will not collect or use your mobile device’s specific location (using, for example, GPS or Bluetooth). Additionally, if you choose to share location information but later change your mind, you will always have the option to stop sharing it. Please note that this does not include your IP address. We will continue using your IP address as described in Section 3.2 above to determine, for example, in which country you are located and to comply with our licensing agreements.
  • Voice: We will not access your microphone without first obtaining your explicit permission. You will always have the option to disable microphone access.
  • Contacts: We will not analyze or import contacts stored on your phone.

3.4. Payment Data
If you sign up for the trial subscription (as defined in the Terms and Conditions of Use), purchase one of our paid subscriptions (as defined in the Terms and Conditions of Use), or make any other purchase through our Service, we and the payment processors we work with may collect and store your credit or debit card information (such as card type and expiration date) and other financial information needed to process your payment. We may also collect certain limited information, such as your postal code, mobile phone number, and transaction history details, all of which are necessary to provide the Service. Additionally, payment processors generally provide us with limited information about you, such as a unique token that allows you to make additional purchases using the stored information, expiration date information, card type, and certain digits of your card number.

If you require an invoice, Mundo Cuervo will collect and store additional information, such as your name, date of birth, and phone number, and provide this information to the payment processors we work with to issue the invoice, conduct credit checks, and send it to you.

BY ACCEPTING THE PRIVACY POLICY, YOU EXPRESSLY AUTHORIZE MUNDO CUERVO TO USE AND SHARE THE INFORMATION YOU PROVIDED TO MUNDO CUERVO, EVEN IF SUCH INFORMATION IS PROTECTED BY LOCAL BANK SECRECY LAWS, WITH OTHER JB GROUP COMPANIES, CERTAIN BUSINESS PARTNERS, AND TRUSTED SERVICE PROVIDERS THAT MAY BE OUTSIDE YOUR COUNTRY OF RESIDENCE (INCLUDING COUNTRIES THAT DO NOT OFFER THE SAME LEVEL OF PROTECTION FOR PROCESSING PERSONAL DATA AS YOUR COUNTRY OF RESIDENCE). YOU ACKNOWLEDGE AND AGREE THAT BY ACCEPTING THIS PRIVACY POLICY, YOU EXPRESSLY WAIVE YOUR RIGHTS UNDER BANK SECRECY LAWS WITH RESPECT TO MUNDO CUERVO, ANY JB GROUP COMPANY, ANY BUSINESS PARTNER, AND TRUSTED SERVICE PROVIDER THAT MAY BE OUTSIDE YOUR COUNTRY OF RESIDENCE. THIS CONSENT WILL BE VALID FOR THE DURATION OF YOUR RELATIONSHIP WITH MUNDO CUERVO.

3.5. Sweepstakes, Contests, and Surveys
From time to time, we may offer you the opportunity to participate in promotions such as sweepstakes, contests, offers, and surveys («special promotions») through the Service. Special promotions will be governed by an additional or independent privacy policy or terms and conditions, separate from this Privacy Policy and the Terms and Conditions of Use. If the provisions of the special promotion’s privacy policy and terms and conditions conflict with this Privacy Policy or the Terms and Conditions of Use, the additional or independent provisions will prevail. If you participate in a special promotion, we may request certain additional information beyond what is specified in this Privacy Policy, including personal information. That additional information may be combined with other account information and may be used and shared as described in this Privacy Policy.

3.6. Mundo Cuervo Partners and Service Providers

    In this section, we describe how you or we may share the information collected or generated by using the Mundo Cuervo service.

5.1. Information You Share

5.1.1. General
Registering with Mundo Cuervo is a social service that offers many ways to find and discover content. We encourage you to take advantage of these social features with other people using the Service.

Please note that some information will always be public, meaning third-party applications can access this information via our Application Programming Interface (API) and development tools. Certain additional information may be shared with third-party applications and others via third-party applications, depending on your permission settings. For example, you can use the settings options to control whether your Mundo Cuervo activity is posted on Facebook. Likewise, you may authorize third-party applications to access your email address, subscription status, location, date of birth, or similar information if requested.

We may use your public information to promote the Service and help others discover Mundo Cuervo content, including through Facebook and other third-party applications and websites that integrate with Mundo Cuervo. Your information may be used to notify others within the Service.

If you explicitly authorize us, we may notify other users of your location. Likewise, if other Mundo Cuervo users explicitly authorize us, we may notify you of their locations. We may offer the option to share this information to create shared experiences.

5.1.2. Third-Party Applications
If you connect your Mundo Cuervo account to a third-party application, Mundo Cuervo will automatically share your activity and stories related to the activity, including the content you are interested in. You understand and accept that this information may be attributed to your account on the third-party application and may be published on that service. Although this information is automatically shared by default, the Your Preferences section below provides information about configuration options to limit shared information. The third-party application may also have similar options.

Mundo Cuervo also allows you to share specific content individually with third-party applications, services, users, and other people. Please note that if you post content to a third-party application or service, other users of the Service will be able to see it, regardless of your Mundo Cuervo account settings.

You understand and accept that the use of the information collected by a third-party application about you (or authorized by you) is governed by that application’s privacy policies and your settings on the relevant service, and Mundo Cuervo’s use of that information is governed by this Privacy Policy and your Mundo Cuervo account settings.

5.2. Information Mundo Cuervo Shares

5.2.1. Marketing and Advertising
We may share information with advertising partners to send you promotional information about Mundo Cuervo or show you more personalized content, including relevant advertising about products or services that may interest you and to understand how users interact with advertisements. We share the information in an anonymous format (e.g., by using hashing) that does not reveal your identity.

5.2.2. Service Providers and Others
Occasionally, we may share your information with service providers to execute and process user data and provide our Service in accordance with this Privacy Policy. For example, we work with service providers that complement our products and analytical service providers that help us better understand the use of our Services. If a third party processes user data on our behalf (e.g., a website hosting provider), they are subject to security and confidentiality obligations that comply with this Privacy Policy and applicable law. If a third party processes user data on its own behalf, the processing is subject to their own privacy policy and applicable law.

    With the configuration options we offer, you can choose what type of communication you want us to send you, manage your public information, and set sharing preferences. However, as explained in the Information You Share section, certain information is set as public for others by default.

    Mundo Cuervo transmits, processes, and stores user information via servers located in various countries. As a result, Mundo Cuervo may share your information with other corporately related companies to carry out the activities specified in this Privacy Policy. Mundo Cuervo may also subcontract information processing or share it with third parties located in countries other than your country of residence. Therefore, your personal information may be subject to privacy laws that differ from those in your country of residence. The aforementioned third parties may transmit and process information collected within the European Economic Area (EEA); these third parties may be located in a country outside the EEA, where you may have fewer legal rights regarding your information.     Mundo Cuervo registration is not intended for individuals under the age of 18. (In some countries, stricter age limits may apply. Please refer to our Terms and Conditions of Use.) We do not knowingly collect personal information from children under 13 years old or those below the applicable age limit (the «age limit»). If you are younger than the specified age limit, do not use the Service or provide us with personal information.     From time to time, we may make changes to the agreements at our discretion. If we make significant changes to the Agreements, we will notify you in a timely manner according to the circumstances, for example, by displaying a prominent notice on the Service or sending you an email. In some cases, we will notify you in advance, and your continued use of the Service after the changes are made will constitute your acceptance of the changes. Therefore, please be sure to read the notice carefully. If you do not wish to continue using the Service under the new Agreement, you may terminate the Agreements and contact us through the Customer Service contact form.

13.1 What Are Cookies and Other Technologies?

Please note that even after opting out of the above mechanisms, you may still receive advertisements while using the Mundo Cuervo service.

We work with advertising partners to include advertisements on the Mundo Cuervo service. One of the services we use to track activities related to the Service, for example, by storing cookies, is Google Analytics from Google (Google, Inc., headquartered at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). We may use providers like Google, which use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and deliver ads based on your previous visits to our website, including Google Analytics Advertising Features.
