These Terms and Conditions govern the use of the website www.mundocuervo.com (hereinafter referred to as «the Website»), owned by Tequila, Espíritu de México, S.A. de C.V. (hereinafter referred to as «TEM»). TEM’s registered office is located at Guillermo González Camarena 800, Second Floor, Colonia Zedec Santa Fe, Álvaro Obregón, C.P. 01210, Mexico City.
By accessing and using the Website and contracting the services offered therein, you accept all the Terms and Conditions set forth on this Website. TEM reserves the right to modify the Terms and Conditions it deems necessary or appropriate at any time without prior notice to the Website users. We invite you to review these Terms and Conditions regularly to be informed of any changes or modifications. Accepting the Terms and Conditions is a mandatory step prior to acquiring any service available through the Website.
The content and use of the Website is reserved exclusively for individuals over 18 years of age.
Through its Website, TEM provides information about its products and services and offers users the opportunity to contract and/or purchase them. Accepting the Terms and Conditions is a prerequisite for the acquisition of any product or service available through the Website.
The user must pay for the products or services purchased through the payment systems that TEM provides on the Website or through TEM’s Call Center. Shipping fees (if any) may be added to the initial price displayed on the website for each product offered. In any case, these fees will be communicated to the user before confirming the purchase for acceptance.
TEM declares that it does not have access to nor store data related to the payment method used by the user when purchases are made through the Website. Only Peek or any other third-party authorized by TEM on the Website, acting as the payment processing entity independent of TEM, will have access to such data for payment and collection purposes. Once the purchase process is completed, the entity will confirm to the user the successful completion of their payment. Payments processed exclusively by Peek on their website are the sole responsibility of the user and Peek, and any matter related to payments or collections made through Peek will be subject to the terms and conditions governing the relationship between the user and Peek.
In the case where purchases are made through the Call Center, the user must make the payment according to the options and instructions provided over the phone.
Once TEM receives confirmation that the user has made the payment, it will email the user confirming the purchase details and, if applicable, attaching the documents that will allow the user to enjoy the contracted services.
If the product purchased by the user requires physical delivery, it will be delivered to the address provided by the user when placing the order, using the shipping service selected by the user. Delivery timelines will be communicated to the user via email with the confirmation of the purchase details. Delivery is considered complete once the shipping company makes the product available to the user at the address specified when the purchase was made. The email confirming the product shipment will also provide a tracking number and the customer service contact number for the shipping company responsible for the delivery so that the user can resolve any issues directly with the company.
TEM, its affiliates, subsidiaries, and licensors, either directly or through agreements with third parties, hold all rights to the content and design of the Website, particularly, but not limited to, the rights over photographs, images, texts, logos, designs, trademarks, trade names, and data included therein. These rights are protected under applicable intellectual property and industrial property laws.
The reproduction, adaptation, modification, distribution, commercialization, public communication of the Website content, or any other action that infringes upon applicable industrial or intellectual property laws, without TEM’s prior express written consent, is strictly prohibited.
TEM informs users that accessing and browsing the Website does not imply the granting of any license, authorization, or implied right over intellectual or industrial property rights or any other right related to the content included on the Website. Users must use the Website responsibly and lawfully, in accordance with these Terms and Conditions. Below are examples of prohibited activities that users must avoid:
i) Distributing, disclosing, or publishing any material that degrades, discredits, humiliates, or threatens others;
ii) Abusing, defaming, harassing, accusing, threatening, or otherwise infringing on the rights of others;
iii) Downloading or uploading files or programs of any kind;
iv) Distributing, disclosing, or publishing indecent material that infringes the rights of third parties;
v) Publishing or sending confidential information, trade secrets, or other proprietary data that is protected by law;
vi) Copying or creating derivative works, displaying, distributing, licensing, publishing, recreating, reproducing, selling, or transmitting any information, products, services, or software obtained from or through the Website;
vii) Monitoring or copying any content through any process;
viii) Engaging in any conduct that conflicts with these Terms and Conditions or that TEM deems inappropriate;
ix) Engaging in any other activity that violates applicable laws, morality, or public decency.
This Website may include discussion groups, news groups, message boards, chat rooms, and other services where third parties participate. TEM is not responsible for any communications or dialogues occurring during such discussions, forums, or chats organized through the Website or any linked pages, and therefore, TEM will not be held liable for any damage caused by such communications or dialogues.
This Website may include discussion groups, news groups, message boards, chat rooms, and other services where third parties, different from TEM and the User, participate. TEM shall not be responsible for any communications or dialogues that take place during discussions, forums, or chats organized through the Website and/or linked pages, nor shall it be held liable for any damages or losses suffered by Users as a result of such communications or dialogues. The information that the User provides in such situations is public, and we recommend not sharing personal data or private information.
In the event that any judicial or administrative authority declares any section, paragraph, or clause of these Terms and Conditions null and void, the remaining sections, paragraphs, and clauses of this document shall remain binding for both parties. To resolve any dispute or conflict arising from these Terms and Conditions, the use or visitation of the Website, or related to the acquisition of products or services through the Website, the parties submit to the applicable laws of the Mexican Republic and to the jurisdiction of the courts in the City of Guadalajara, Jalisco, Mexico, expressly waiving any other jurisdiction that may apply by reason of their present or future domiciles.

Thank you for visiting the Jose Cuervo Express® page. Tequila, Espíritu de México, S.A. de C.V. (hereinafter referred to as «TEM») is the commercial entity that sells tickets for the Jose Cuervo Express® train. TEM is located at Guillermo González Camarena 800 Segundo Piso, Colonia Zedec Santa Fe, Álvaro Obregón, C.P. 01210, Mexico City, and can be contacted at the following phone numbers: (01 374) 742 67 29 and (01 374) 742 67 26 for group inquiries. We invite you to contact us if you have any questions, comments, or complaints.

The content and use of the Website is reserved exclusively for individuals over 18 years of age.
I. DEFINITIONS
a) Ticket: A document issued physically or electronically by TEM that grants the right of access to the selected service. The corresponding invoices must be processed as specified in your reservation and/or boarding pass.
b) Call Center: The center authorized by TEM for information, reservation, modification, cancellation, and ticket sales.
c) Trip: The one-way or return journey of the Jose Cuervo Express® train between the Guadalajara – Tequila – Guadalajara stations.
d) Station: The facilities where the departure and arrival of the Jose Cuervo Express® train take place, located at the following addresses:
● Ferrocarriles Mexicanos Station (Ferromex): Av. Washington # 11, Col. Moderna, 44190 Guadalajara, Jalisco.
● Tequila Station: Héroe de Nacozari s/n, Colonia La Estación, in Tequila, Jalisco.
● Casa Cuervo – EDISA: El Mante 8502, El Mante, 45080 San Pedro Tlaquepaque, Jalisco.
e) Jose Cuervo Express®: The train through which TEM provides services.
f) La Rojeña: The distillery located at Calle de Jose Cuervo #73, Colonia Centro, Postal Code 46400, in Tequila, Jalisco, Mexico.
g) Sales Module: Refers to the points of sale located at: (i) the ticket office at Mundo Cuervo®, located at Calle Jose Cuervo # 73, Colonia Centro, Postal Code 46400, in Tequila, Jalisco, Mexico; (ii) the «Tequila World» store, located on the ground floor of Hotel Camino Real Guadalajara, located at Avenida Vallarta #5005, Colonia Chapalita, in Guadalajara, Jalisco, Mexico; (iii) «Tequila World» store at Hotel Hilton, located at Avenida de las Rosas 2933, Colonia Rincón del Bosque, C.P. 44530, in Guadalajara, Jalisco, Mexico.
h) Mundo Cuervo®: The facilities located at Calle de Jose Cuervo #73, Colonia Centro, Postal Code 46400, in Tequila, Jalisco, Mexico.
i) Tour: The experiences offered by TEM.
j) Website: The Internet page josecuervoexpress.com.
k) TEM: The business entity named Tequila, Espíritu de México, S.A. de C.V.
l) Terms and Conditions: The set of provisions established by TEM, under which the services contracted by you will be provided.
m) «Tequila World» Store: The commercial establishments located at: (i) the ground floor of Hotel Camino Real Guadalajara, located at Avenida Vallarta #5005, Colonia Chapalita, in Guadalajara, Jalisco, Mexico; (ii) the ground floor of Hotel Hilton, located at Avenida de las Rosas 2933, Colonia Rincón del Bosque, C.P. 44530, in Guadalajara, Jalisco, Mexico.
II. TICKET PURCHASE AND PAYMENT METHODS
Tickets are valid solely and exclusively for a single Tour, on the confirmed date stated on your boarding pass, and can be purchased through the following means:
II.1. Ticket Purchase via the Website.
By accessing the Website, you can reserve as many Tickets as you wish, in accordance with their availability, and proceed to pay for the Tickets you have reserved through Peek (an entity independent of TEM).
Once TEM personnel receive confirmation of said payment from Peek, they will email you the Ticket, which you must print and present at the time of boarding. Without this, you will not be allowed to board.
TEM does not have access to or store any information regarding the payment method used by you. Only Peek, an entity independent of TEM, has access to this data for the purpose of managing payments and collections. Therefore, you acknowledge and accept that TEM is not responsible for the services provided by Peek, and for any claims arising from them, you must take appropriate actions against Peek directly.
Once the purchase process is complete, Peek must confirm the successful completion of your payment. The processing of payments and collections for the products and/or services selected by you on the Website is carried out exclusively by Peek on its own website, so any issues related to payments or collections made through Peek will be subject to the terms and conditions that govern the relationship between you and Peek.
II.2. Ticket Purchase via the Jose Cuervo Express® Call Center.
Through the Jose Cuervo Express® Call Center, you can reserve and purchase Tickets, subject to availability and the payment method indicated, by calling (01 374) 742 67 29.
During the call, you will be provided with a reservation number, which you can use to pay for your Tickets. You can pay via bank transfer to the beneficiary account that will be provided to you or by cash or credit card at any of our Sales Modules. Once the payment is made, you must confirm it by either sending a copy of the payment receipt to the email address [email protected] or by visiting the «Tequila World» stores.
If you go directly to the «Tequila World» store to make the payment or present the payment receipt, you will receive a physical payment receipt.
If you sent the payment receipt to the indicated email address, once the Jose Cuervo Express® personnel have received confirmation of said payment, they will send you a boarding pass to the email address registered in the reservation. You must print and present this pass at the time of boarding, without which you will not be allowed to board.
II.3. Ticket Purchase via Sales Modules
You can purchase Tickets for Jose Cuervo Express® directly at any of the Sales Modules, paying through authorized credit or debit cards or cash, as applicable.
II.4. General Provisions Regarding Ticket Purchase
If you did not receive the Ticket by email, contact the Jose Cuervo Express® phone numbers mentioned above.
II.5. Check-in
If your purchase is made through our websites www.mundocuervo.com or www.josecuervoexpress.com, it is important to consider that to make the purchase:
It is essential to present a printed reservation confirmation, an official ID, and proof of payment upon arrival:
Payment by credit/debit card: The cardholder must be present with the credit/debit card used for payment.
SPEI Payment: Proof of transfer is required.
If the required documents according to the type of payment are not presented at check-in, the reservation payment must be made again, or boarding the train will be denied.
Please note that Jose Cuervo Express recognizes only the following official electronic platforms for ticket sales: www.mundocuervo.com, www.josecuervoexpress.com, and the phone numbers (01 374) 742 67 29, Tequila World stores at Camino Real (01 33) 3621 0293, Hilton store (01 33) 3671 5030/74, and La Rojeña store (01 374) 742 07 00 Ext. 6761.
For your safety, we advise against purchasing tickets from individuals or unauthorized companies, as Jose Cuervo Express is not responsible for refunds in such cases.

III. SEAT ASSIGNMENT
At the time of booking Tickets, Jose Cuervo Express® reserves the right to assign the seats, which will be informed to you on your boarding pass.
IV. CHANGES AND REFUNDS
IV.1. Once the payment is made, you accept that you will not be able to request a refund of the Ticket cost due to cancellation, except in the case outlined in section five of these Terms and Conditions, titled «Cancellation of Trips by Jose Cuervo Express®,» or in the case of an overpayment made by the passenger.
IV.2. Change of Date
Any request to change the travel date that is notified at least 24 hours before the confirmed date will incur a penalty fee, based on the following parameters:
● 30 days before the event: 10%
● 14 to 29 days before the event: 15%
● 7 to 13 days before the event: 25%
● 6 to 1 day before the event: 50%
IV.3. Itinerary Change
Changing the itinerary in confirmed reservations will result in a penalty fee of 10% of the total amount paid.
V. CANCELLATION OF TRIPS BY JOSE CUERVO EXPRESS®
Jose Cuervo Express® and TEM will act diligently to comply with the established dates and times; however, the schedules and dates of the Trips may be modified or canceled by Jose Cuervo Express® and/or TEM without prior notice or due to unforeseeable circumstances or force majeure, without any liability for Jose Cuervo Express® or TEM. If applicable, TEM will refund the User the cost of the Ticket in accordance with these Terms and Conditions or reschedule the travel date. In any case, the refund will be processed directly through TEM, using the system implemented by TEM for this purpose.
VI. BOARDING
You must be at the boarding gate at least 1 hour prior to the departure time of the respective Trip. In order to board, you must present to TEM and/or Jose Cuervo Express® staff your boarding pass and an official photo ID.
Boarding closes 20 minutes before each trip’s departure time. If you arrive at the boarding gate after the specified time, you will not be allowed to board according to these Terms and Conditions, forfeiting the corresponding Ticket and not being entitled to request a refund.
If you fail to arrive on time at the Tequila Station and do not board, the return trip to Guadalajara will be at your own expense and cost, without any responsibility for TEM.
VII. TOURS, CARRIAGES, FARES, AND ITINERARIES
All the fares for the Tours are listed in Mexican Pesos, the legal currency of the United Mexican States, and include Value Added Tax (IVA). The applicable rates will be those corresponding to the time of purchase. Additionally, the schedules of the trips will be the ones published at the time of purchase and may be modified without prior notice.
Jose Cuervo Express® has 7 carriages:
a) 3 passenger carriages
b) 4 service carriages
VII.1. CUSTOMIZED TRIPS
You can arrange a private trip for any event, either by booking a carriage or the entire train, after receiving a quote for the requested services. These are subject to available dates and itineraries through the group sales department: [email protected] (01 374) 742 67 26.
VIII. GUIDES
You will be accompanied by a guide, who will be with you from the start, during the train tour, at La Rojeña’s facilities, and at Mundo Cuervo®, if applicable, until the return to the Station. The guide is contracted.
IX. MINORS (-18). Youth between 13 and 17 years old.
They will only have access to the passenger carriages.
Under no circumstances will they be allowed to purchase or consume alcoholic beverages.
They must be accompanied by an adult at all times during the contracted Tour.
Children under 6 years old will not be charged for a Ticket and will not have an assigned seat.
X. FOOD AND BEVERAGES
The entry of beverages and/or food is prohibited in any of the Jose Cuervo Express® carriages, as well as in the facilities of La Rojeña and Mundo Cuervo®.
«It is the passengers’ responsibility to consume alcoholic beverages responsibly in our facilities; nevertheless, we reserve the right to limit or even deny alcoholic beverage service to passengers in an inappropriate state.»
XI. ANIMALS
Bringing animals into any of the Jose Cuervo Express® carriages, as well as the facilities of La Rojeña and Mundo Cuervo®, is prohibited.
XII. SMOKING
Smoking is prohibited in all areas of any of the Jose Cuervo Express® carriages, as well as in any area within the facilities of La Rojeña and Mundo Cuervo®.
XIII. PROHIBITED ITEMS AND SUBSTANCES.
It is prohibited to bring the following items and substances, including but not limited to, into any of the Jose Cuervo Express® carriages, as well as into the facilities of La Rojeña and Mundo Cuervo®:
a) Firearms, rifles, or any object capable of or appearing to be capable of causing injury by discharging a projectile, including all types of firearms, replicas or imitations of firearms, firearm components and/or parts, air pistols, air rifles and pellet guns; distress signal guns, toy weapons of all kinds, paintball guns, industrial staplers and nail guns, crossbows, catapults, harpoons, and spear guns, or any weapon that constitutes a danger to the physical integrity or life of individuals.
b) Electroshock devices, laser energy-conducting weapons, or any device that transmits any type of energy that endangers the physical integrity or life of individuals.
c) Sharp and pointed weapons and objects capable of causing injury, including but not limited to knives, axes, arrows, darts, steel staplers, steel hooks or spikes, steel climbing plates with spikes, spears, ice axes, ice picks, ice skates, meat cleavers, machetes, razors and shaving machines, sabers, swords, scalpels, scissors of any size, skis and ski poles, mountain hiking sticks, throwing stars, tools that could be used as sharp or pointed weapons, all types of saws, screwdrivers, pliers, crowbars, hammers, and tongs.
d) Flammable substances and explosives, any explosive substance that endangers the physical integrity or life of passengers and crew, including but not limited to, ammunition, detonators and fuses, explosive devices, as well as replicas and imitations of these, mines, bombs, and any type of gas containers (butane, propane, acetylene, large quantities of oxygen), fireworks, matches and/or lighters, smoke generators or cartridges, flammable liquid fuels, petroleum, gasoline, diesel, alcohol, ethanol, spray paint, thinner.
e) Chemical and/or toxic substances that endanger the physical integrity or life of passengers and crew, including but not limited to, acids and alkalis, liquid batteries that may leak, corrosive and/or bleaching substances, mercury, chlorine, disabling sprays, radioactive material, commercial or medical isotopes, biological and/or infectious materials, blood, materials susceptible to instant combustion, fire extinguishers.
f) Psychotropic or narcotic substances of any nature that endanger life or alter behavior or consciousness, or controlled medications without a prescription issued by a licensed physician justifying their use.
XIV. DISCLAIMER OF WARRANTIES AND LIMITATIONS OF LIABILITY
TEM will act diligently to ensure that the Site’s content is available at all times; however, TEM may, at any time and without prior notice, interrupt or cancel access to the Site and/or its content without any liability on the part of TEM.
TEM shall not, under any circumstances, be liable for damages or losses arising from or related to the use of the Site and/or its content, including but not limited to, loss of data, information, or programs, or damage to computers or networks. TEM expressly reserves the right to modify the Terms and Conditions and/or the content of the Jose Cuervo Express® Site without prior notice. These Terms and Conditions and/or the content of the Site may contain errors and/or inaccuracies.
Third parties other than TEM and You may have access to the Site’s content, and they could change or delete such content without TEM’s authorization. TEM informs you that it shall not be liable in the event that such unauthorized changes made by third parties affect the Site’s content.
There are no additional warranties from TEM other than those corresponding to the services provided by TEM under this document and expressed in these Terms and Conditions. TEM does not recognize any warranties of any kind or nature not specified here. No information provided by agents or employees of TEM or any third party authorized by TEM or the Site shall create any warranties in relation to the Terms and Conditions or the Site. The products and services offered on the Site are the only ones authorized by TEM, and therefore TEM shall not be responsible for any other products or services offered by any third party other than TEM.
XV. INDUSTRIAL AND INTELLECTUAL PROPERTY
Jose Cuervo Express® and Mundo Cuervo® are registered trademarks with the Mexican Institute of Industrial Property, in accordance with the Industrial Property Law, owned by Tequila Cuervo, S.A. de C.V. Any unauthorized use of these trademarks will be penalized in accordance with the applicable legislation in force.
TEM and its affiliated or related companies hold all licenses and authorizations to use the intellectual property rights related to the content and design of the Website, including, but not limited to, the photographs, images, texts, logos, designs, trademarks, trade names, and data included therein. These rights are protected by the applicable intellectual property legislation.
XVI. USE OF THE SITE
TEM provides the Site solely to allow you to check the availability of the services and Recorridos it offers and to make reservations and purchases for those services.
You agree not to misuse the Site. Misuse includes, but is not limited to, the following activities, which are strictly prohibited:
a) Distributing, disclosing, advertising, or publishing any information or material that degrades, discredits, shames, humiliates, or threatens individuals.
b) Abusing, defaming, harassing, accusing, threatening, or otherwise violating the rights of others.
c) Downloading or uploading files or programs of any kind.
d) Distributing, disclosing, advertising, or publishing any indecent material or information contrary to public morals or that infringes upon third-party rights.
e) Advertising or sending, or otherwise disclosing confidential information, trade secrets, or other proprietary, confidential, and/or protected data.
f) Copying or creating derivative works from, displaying, distributing, licensing, performing, publishing, recreating, reproducing, selling, transferring, or transmitting any information, products, services, or software obtained through or from the Site.
g) Monitoring or copying any content through any process.
h) Engaging in any other conduct that, in TEM’s judgment, conflicts with these Terms and Conditions.
i) In general, engaging in any acts against the applicable laws, morality, and good customs.
XVII. INDEMNIFICATION
You acknowledge and agree that you will be responsible for indemnifying and holding TEM, its affiliates, subsidiaries, and/or any company corporately related to it harmless from any damages and losses arising from the breach of these Terms and Conditions, as well as any damages and losses arising from or related to the improper use of the Site.
XVIII. HEADINGS AND CLAUSES
All titles, headings, and clauses in these Terms and Conditions are used solely for reference purposes and will not affect the content or interpretation of the same.
XIX. SURVIVAL OF TERMS AND CONDITIONS
In the event that any judicial or administrative authority declares any section, paragraph, or clause of these Terms and Conditions null and void, the remaining sections, paragraphs, and clauses of this document will continue to be binding on the parties. In accordance with the Law Regulating Railway Services and its Regulations, you will be protected with the corresponding insurance from the moment you board the Jose Cuervo Express® train.
XX. JURISDICTION AND APPLICABLE LAW
You agree that the interpretation, fulfillment, and/or any disputes related to or arising from these Terms and Conditions, your visit to the Site, or the services you acquire will be governed by the applicable laws in force in the United Mexican States and will be subject to the competent courts in the city of Guadalajara, Jalisco, Mexico, expressly waiving any other jurisdiction that may correspond to you due to your present or future domicile.
